General Terms and Conditions for Laminate Warranties

First of all I VANQUISH are great to welcome you as a one of the world best quality flooring owner. Your flooring carry the specific warranties listed below. In addition to the requirements specified for each of those particular warranties, the end user who are deal with I VANQUISH dealer, partner, the following general terms and conditions also apply. If you have questions regarding the warranty information, please contact our sales team or thru our dealer, retailer, care line or our website www.ivgroup.com.my.

  1. This warranty applies only to the first owner and the first installation of the product and may not be transferred. The "first owner" is the person stated as the buyer on the purchase document(s). This warranty applies only to first quality I VANQUISH brand product purchases made after the edition date of these warranty conditions for the designated time period.

  2. This product warranty only applies to defects inherent to the material supplied. This means any material or production defects, acknowledged by the manufacturer. It includes the de-lamination or reduced resistance of the wear layer, but does not include, in beveled-edge products, wear along the edges of the panels less than 3/16"(5mm) from the edge. I VANQUISH will repair or replace the product, at its option. When replacement of the flooring is made, only new panels from the current product range at the time the complaint is upheld will be supplied by the distributor or retailer. There will be no other form of compensation. Responsibility under this warranty only applies to hidden defects. These are defects that were not visible before or during the installation of the laminate floor. I VANQUISH can never be held liable and is not responsible for any secondary damage.

  3. The interlocking of I VANQUISH Click Joint warranty only applies to open joints greater than 0.01 inches (0.2mm).

  4. This warranty applies only to first quality I VANQUISH brand product installed according to the manufacturer's recommended installation instructions in indoor climate controlled spaces.We recommend using the approved I VANQUISH profiles and skirting accessories as they have been specifically designed and tested for use with I VANQUISH flooring boards. The use of accessories other than I VANQUISH accessories might cause damage to the floor. In such cases, the warranty provided by I VANQUISH will be void. Proof of compliance with the installation and maintenance instructions recommended by the manufacturer must be provided if a claim is filed. These instructions are located inside 1 out of every 3 flooring cartons or in each individual accessory package. If the instructions are not there, they should be requested from the manufacturer, distributor or retailer. If installation is not performed by the end user or I Vanquish authorise installer, the warranty of the laminated flooring is void.

  5. This warranty does not apply to laminate flooring that has been put to abnormal use or conditions or abused in any way. "Abnormal use or conditions" includes, but is not limited to, water damage from plumbing, storm or flood, damage from smoke, fire or other casualty events; damage caused by negligence, improper alterations of the original manufactured product. "Abuse" is any use of the flooring that is unreasonable considering the normal and expected uses of a laminate floor in a medium commercial environment. The damage to the product must be evident, measuring, per product unit (panel, accessory, etc.) at least 1.40 square centimeter or 0.5 square inch, and must not be the result of abusive, abnormal conditions or accidents, such as but not limited to, damage of mechanical nature, severe impact or scratches (caused by dragging objects or furniture) or cutting. The feet of furniture must always be covered with appropriate protective material. Chairs, sofas or furniture with castors must be fitted with soft rubber wheels, an adequate protective mat or protective castor cups must be put under this furniture.

  6. A suitable mat or sufficiently large transition area at the entrance door(s) must be used to prevent sand and/or dust from damaging the flooring.

  7. This warranty does not apply to damage from exposure to extreme heat, dryness, water saturation or stains as a result of chemical or industrial products (other than recommended cleaning products). The floor may not be installed in damp and/or humid areas, in extremely dry areas or areas where there are extremely high temperatures (such as saunas or swimming pool areas).

  8. This warranty excludes damage caused by water, including but not limited to natural disasters (i.e. floods), naturally occurring conditions/accidents (i.e. appliance and plumbing failures), urine or standing water (water that remains on the floor longer than 30 minutes). The water resistance warranty does not apply to products that are less than 8mm thick and does not apply to beveled edge products when used in bathrooms.

  9. This warranty excludes damage caused by water or moisture trapped beneath the floor due to improper sub-flooring or underlayment including but not limited to damage from hydrostatic pressure (water or moisture under the floor that is transmitted to the surface through exerted pressure) or other conditions that result in water or moisture being below the floor.

  10. This warranty excludes damage caused by moisture left on the floor (or on or around the skirting boards, wall base or profiles), cleaning that is too wet and/or the use of inappropriate cleaning products. Prolonged water exposure could damage your laminate flooring.

  11. Flooring panels or accessories must be checked carefully for material defects before and during installation and under sufficient lighting. Products with visible defects must not be installed under any circumstances. The distributor or retailer must be informed in writing of such defects within 15 days. After this time has elapsed, no further complaints will be accepted. Color and gloss issues resulting from material added to an existing installation at a later date and non-warranty repairs are excluded from coverage.

  12. Under no circumstances will I VANQUISH be responsible for any loss of time, inconvenience, expenses, costs or other consequential damages caused by or resulting directly or indirectly from a problem about which a claim was made.

  13. I VANQUISH Flooring OFFERS NO OTHER WARRANTY, EXPRESS OR IMPLIED, THAN THE ONE DESCRIBED HEREIN, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR SUITABILITY OF THE PRODUCT FOR A PARTICULAR PURPOSE, AND NO OTHER REMEDIES SHALL BE AVAILABLE EXCEPT FOR THOSE PROVIDED HEREIN.

  14. If there is a conflict between these general terms and conditions and the terms and conditions of the warranties as specified, the terms and conditions of the warranties as specified shall control. The company, I VANQUISH, shall remain the rights of amend, change, upgrade the terms and conditions of the warranty by time to time to provides better services and warranty to the customer.

  15. The company reserve the rights to void the warranty of the laminated flooring, if there are conflict between the master dealer, dealer, or distributor or consumer. The decision of the company is final.

*Product is warranted to the original purchaser for a period after date of purchase for manufacturing defect. Installation error is not covered. Replacement is limited to material unless defect was not apparent prior to installation.


What I VANQUISH floor will do if:

If a product problem under warranty is acknowledged, and after investigate confirm that is the floor board problems, I VANQUISH will replace defective planks with planks of the same design, if available, or another design of equal value. You will be responsible for any labour costs associated with the removal of the damaged floor and installation of the replacement floor. I VANQUISH is not responsible for labour charges, installation charges or similar costs. Consequential, special and incidental charges are not recoverable under this warranty. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you.

THERE ARE NO OTHER IMPLIED WARRANTIES OTHER THAN THE I VANQUISH EXPRESS WARRANTY.

This warranty does not cover damage to the product caused by:

  • Installation error - Installation manuals are available inside the floor board box or online at www.ivgroup.com.my or your may call our care line 019-6899988 for details. (Please note: product with surface defects are not to be installed under any circumstances.)
  • Accident, product misuse or product abuse, damage caused by vacuum beater bars or the vacuum's casters, insufficient protection from furniture, items such as scratches, blows, cuts, chips, dents or damage caused by sand or other abrasive materials, whether caused by a service company or a consumer.
  • Non-residential or commercial use.
  • Extreme heat or cold.
  • Freight damage.
  • Damages by acts of God.
  • Improper care and/or maintenance of the flooring.
  • Flooding, from natural disasters or appliance failure, standing water or water that is trapped between the sub-floor and the I VANQUISH floor. Pet urine or caustic substances such as leach. The sub-floor moisture may not be more than 12% moisture in a wooden sub-floor or more than a measurement of 5 pounds/24 hours/1,000 square feet on a concrete floor using a calcium chloride test. Hydrostatic pressure in concrete. Water that has not been promptly removed (as required by the Warranty).
  • Water damage from excessive moisture in a concrete slab, hydrostatic pressure, flooding caused by ice makers, refrigerators, sinks, dishwashers, leaking pipes, flooding, standing water, household mechanical failures, damage caused by water underneath the flooring, including damage from subfloor hydrostatic pressure or other conditions that result in water being below the flooring or natural disasters.
  • This warranty does not cover defects that are not clearly visible, such as surface wear, stains or fading less than one square inch in size.
  • This warranty does not cover gloss as gloss is subjective to lighting conditions. If the boards do not appear to match each other for gloss or sheen they must not be installed. Samples of each must be sent to I VANQUISH for evaluation.
  • Noise produced when the flooring is walked on is not a warranty item. On any wood based mechanical locking floor, the floor has the ability to produce noise when walked on.
  • WE EXCLUDE AND WILL NOT BE LIABLE FOR OR PAY INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES UNDER OUR WARRANTIES. By this we mean any loss, expense, or damage other than to the flooring itself that may result from a defect in the flooring. Our limited warranties constitute the only express warranties for the product purchased.
  • TO THE EXTENT PERMITTED BY LAW AND FOR ALL NON-CONSUMER PRODUCT, ALL WARRANTIES OTHER THAN OUR LIMITED WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED. IF ANY IMPLIED WARRANTY ARISES UNDER STATE LAW, ANY AND ALL IMPLIED WARRANTIES (INCLUDING ANY WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) ARE LIMITED IN DURATION TO THE DURATION OF THIS WRITTEN WARRANTY, TO THE EXTENT ALLOWED BY LAW.

None of our installers, retailers, distributors or employees has the authority to alter the obligations, limitations, disclaimers or exclusions under any of our warranties.


THE WARRANTY CLAIMS

To make your warranty valid, you MUST keep the attached Warranty Certificate, with a copy of your original purchase sales receipt, sales order confirmation, payment receipt. If you need to file a claim, do so through the retailer from whom you purchased the product. Along with your claim, I VANQUISH may require samples of the complaint (i.e. laminate boards in question). I VANQUISH may (at I VANQUISH discretion) also send an independent inspector to the installation in order to obtain additional information for the claim. I VANQUISH will determine if an independent inspection is necessary and, if so, I VANQUISH and the customer will order and pay for the independent inspection. All information regarding your claim will come from your retailer.

This warranty is issued to the original retail consumer and is not transferable. The limited warranty applies only when the affected area is visible and covers a flooring area greater than one square inch. Proof of purchase in the form of a sales receipt or other establishing document is required when requesting warranty service.

We exclude and will not pay incidental or consequential damages under this warranty. By this we mean any loss, expense, or damages other than to the flooring itself that may result from a defect in the flooring. No implied warranties extend beyond the term of this written warranty.

Your warranty applies only to you, the original purchaser, for one installation. Removal, reinstallation or unauthorized repairs shall void this warranty.

*Manufacturing: In addition to the Original warranty, We warrant our product against manufacturing defects that exist in its product prior to purchase by the consumer. Any manufacturing defect must be reported prior to the product installation or, under any circumstance, no later than six (6) months after the date of purchase in order to be covered under this warranty. We will replace any such defective material at no additional cost to the customer. Any damage that might occur during shipment is the responsibility of the shipping company.
